HERE'S HOW IT WORKS: Visit www.sincityonmax.com to register and submit an original video ("Video") of yourself describing any of the following: your fantasy guy/girl, date scenario, your favorite part of a guy/girl, what makes a guy/girl sexy, or what the word “sexy” means to you. But make sure to keep it clean if you want to be eligible for posting/judging. Videos must not exceed 1 minutes 30 seconds in length, videos that exceed this length will be disqualified. Video file must be 25 MB or smaller and in .flv, .wmv, .asf, .avi, .mov, .3gp, .mpg, .mpeg, or .mp4 file format. Limit one contest entry per person per Round. Entries for each Round must be received within the corresponding entry period indicated in the chart below to be eligible for that Round. One Finalist will be selected in each of the first 4 Rounds. The 4 Finalists will then advance to Round #5, an exclusive Round for Finalists, for an opportunity to win the Grand Prize.

Your video must only feature yourself as the entrant; noncompliance with this or any other Official Rule will result in disqualification. Limit one website registration per person. If any person submits more than one contest entry in a Round, only the first such entry received for that round will be deemed eligible. IMPORTANT: Any entry submitted by an entrant, which in the sole opinion of Sponsor and/or judges, is inconsistent with the theme or spirit of the contest, is unsuitable for public viewing and/or deemed inappropriate (e.g., defamation, nudity, violence, inappropriate acts, or violates any copyright/trademark, etc.) will be disqualified; see Rule #7 "Terms of Submission" for additional details.
ROUNDS #1 THROUGH #4 JUDGING: One Finalist will be selected in each of the first 4 Rounds. All eligible entries in each Round will be judged by based on the following criteria: originality and creativity (50%); humor (30%); appropriateness to contest theme (20%). In the event of a tie, tied entries will be rejudged by a panel of judges in accordance with the above criteria.
ROUND #5 COMPETITION: The 4 Finalists videos will automatically advance to Round #5, an exclusive Round for Finalists only. A maximum of (115) points can be obtained in this Round through Public Voting and Judging, which will be conducted as follows:
PUBLIC VOTING (15 points available): NOTE: Voting is NOT the sole factor in determining the Grand Prize winner; see Rule #4 for details. Beginning on or about 7/3/07, the 4 Round #5 Finalist videos will be displayed on the contest website, www.sincityonmax.com. Registered website visitors will have the opportunity to cast one vote per registration per day (Eastern Time) for the entry they feel is the most entertaining. Limit one website registration per person. If more than one vote is received per person in the same day, only the first such vote received for that day will be eligible. The voting period will end at 11:59 PM on ET 7/14/07. The total number of eligible votes received for each entry will be mathematically converted into a point value ranging from 0 (no votes) to 15 (unanimous votes) by applying the ratio of votes received for each Finalist to total votes cast for all entries. Any individual who, at the sole discretion of the Sponsors, abuses the voting process in any way, including mass voting or votes generated by a script, macro, use of automated devices or attempt to undermine the integrity of the voting process may result in disqualification. Any attempt by an individual to vote on a video more than once per day through any means, including but not limited to the use of multiple registrations or email accounts will result in disqualification of all votes by that individual. Public voting is based strictly on criteria set forth in the Official Rules. If technical malfunctions, inappropriate conduct of Finalists (including, without limitation, attempting to improperly influence voting by offering prizes, money or other consideration for receiving votes) or suspect selections/irregularities corrupt the voting portion of the contest, Sponsor reserves the right, in its sole discretion, to disqualify any Finalist engaging in such conduct and/or award prizes based solely on the judging and non-suspect online voting.
JUDGING (100 points available): The 4 Round #5 entries will be rejudged in accordance with the judging criteria outlined in Rule #2. Scores received from judging will be converted from a percentage to points; 1 percent equals 1 point.
DETERMINING THE GRAND PRIZE WINNER: The Finalist with the most combined points received in the Round #5 Public Voting phase (Rule #3A) and Round #5 Judging phase (Rule #3B) will be deemed the Grand Prize winner, subject to the verification of eligibility. All points received will be totaled by D.L. Blair, Inc., an independent judging organization whose decisions are final. If at the conclusion of Round #5 Public Voting and Round #5 Judging, a tie needs to be broken, tied entries will be rejudged in accordance with the process outlined in Rule #2.
PRIZE AND APPROXIMATE RETAIL VALUE: (1) Grand Prize - A 3-day/2-night trip for winner and a guest to Las Vegas, Nevada, prize includes round-trip coach air transportation from the major airport nearest winner's home, hotel accommodations (1 room, double occupancy), two tickets to a Sponsor selected entertainment event, and $250 spending money for winner (ARV: $2,750.) Guest must be at least twenty-one (21) years of age and possess valid travel documents. If winner resides within 250 miles of Las Vegas, Nevada, winner will receive a $150 travel stipend in lieu of air transportation. Winner may opt for cash value of prize in lieu of stated Grand Prize. Prizes consist only of those items listed as part of the prize.
GENERAL RULES: Open to residents of the 50 United States and the District of Columbia who, as of 6/1/07, are 21 years or older. Void where prohibited by law. Employees of HBO, EROI, Kick Apps, their affiliates, subsidiaries, advertising, promotion agencies, and their immediate families and those living in same household of each are not eligible. Professional entertainers (i.e., anyone who has received compensation for writing or acting, as determined by Sponsor) are not eligible. Past and/or current members of the Screen Actors Guild (SAG) and/or American Federation of Radio and Television Artists (AFTRA) are ineligible. All federal, state and local laws and regulations apply. Potential Finalists and Potential Grand Prize winner will be notified by telephone/mail and/or e-mail. Sponsor assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user's internet service provider and/or email client or for insufficient space in user's email account to receive email. All potential Finalists must complete and return an Affidavit of Eligibility/Release of Liability/Publicity Release Form within 7 days of receipt. Noncompliance within this time period may result in disqualification and an alternate Finalist will be determined, time permitting. If any potential Finalist is disqualified, an alternate potential Finalist will be selected from the same Round from which he/she was selected, time permitting. All travelers must execute a Release of Liability prior to ticketing and must possess required travel documents (e.g., valid photo I.D.) prior to departure. Winner may make no substitution or transfer of prize. Travel must be completed within 1 year of notification. Any Sponsor approved changes to confirmed travel itinerary, made at winner's request, may result in rebooking fees which will be the sole responsibility of winner. All federal, state and local taxes are sole responsibility of winner. Sponsor in its sole discretion reserves the right to not award prizes in the event that there is an insufficient number of qualified entries. Proof of submission will not be deemed proof of receipt. Sponsor not responsible for incomplete, lost, late, damaged, illegible or misdirected mail/e-mail or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor not responsible for any damage to any participant's computer system/software related to or resulting from participation or downloading any materials in this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Any use of robotic, automatic, programmed, or the like methods of participation (including voting) will void all such submissions by such methods. The contest may be cancelled if infected by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes outside control of Sponsor or its promotional partners which impair or affect the administration, security, fairness, integrity, or proper conduct of this promotion. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the contest and to cancel, modify, terminate or suspend the contest. In the event of termination, a notice will be posted on the promotional website and all eligible entries received prior to the time of termination will be judged by Sponsor to determine a Grand Prize winner (i.e., the voting portion may be suspended.) By participating in this contest, participants must certify that all elements of contest submission is his/her own original work, he/she has not received any professional guidance and no portion of entry is not subject to any collective bargaining agreements and that he/she has followed the Official Rules of this contest, and agrees to waive all rights, title, interest in submitted material and assigns all rights, title, interest to Sponsor. By uploading your entry, you agree that your entry will become the property of Sponsor. By participating in this contest, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and judges which are binding and final on all matters relating to this contest. By participating, entrant agrees to hold Sponsor and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively "Released Parties") harmless against any and all claims, injuries, losses and liability for any injuries, losses or damages of any kind, including death, to persons, or property arising in whole or in part, directly or indirectly out of acceptance, possession, use or misuse of prize (including any travel or activity related hereto) or participation in the contest. Sponsor and its promotional partners accept no liability for content of entries. Sponsor reserves the right to substitute prize of equal or greater value. All entrants consent to use of name, likeness, entry material in any manner by Sponsor and/or its promotional partners for advertising and trade without further compensation, unless prohibited by law. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Winner assumes all liability for any injury, damage caused or claimed to be caused by participation in this promotion or use or redemption of any prize.
TERMS OF SUBMISSION: You represent, warrant and agree that you are the sole creator of the Video (you both appear in the Video and filmed the Video yourself) or, if you are not the sole creator of the Video, you have the express permission of any person who helped you film the Video to upload the Video and to grant the rights you grant herein. By submitting your Video, you also represent, warrant and agree that you have all rights, approvals and/or consents necessary to submit the Video on the terms provided and your Video
Your Video must be your original work and must not contain any third-party music or other third-party content or other materials (such as writing, poetry, text, graphics, artwork or logos), or any inappropriate or offensive materials. Any Videos containing nudity, material that is violent, pornographic or otherwise obscene, illegal, racially or morally offensive, or likely to transmit or contain a virus, corrupted file or any similar element as determined by Sponsor, in its sole discretion, may be rejected or removed from this site. Videos must comply with all laws, rules, and regulations including, but not limited to, those concerning copyright, plagiarism, trademark, defamation and invasion of privacy. By uploading your Video, you agree that: (i) all Videos become the property of Sponsor, and (ii) you grant to Sponsor and its affiliates and partners all rights to use, store, display, publish, transmit, transfer, distribute, reproduce, create derivative works of, alter and/or edit and publicly perform your Video or any part or element thereof. Sponsor and its licensees, successors and assigns have the right (but not the obligation) to use any and all Videos for future advertising, promotion and publicity in any manner and in any and all media now known or hereafter devised throughout the world in perpetuity.
YOU WILL NOT BE PAID FOR YOUR SUBMISSION or for granting any of these rights. You agree to waive all claims to and shall receive no royalties of any kind now or in the future from Sponsor, its affiliates, or its licensees, successors and assigns for use of your Video on the Site or otherwise, and you represent, warrant and agree that no other party is entitled to claim royalties from the use of the Video as set forth in these Terms of Submission. Your Video shall not be subject any collective bargaining agreements. You agree to indemnify, defend and hold harmless Sponsor and its affiliates, licensees, successors and assigns from and against any and all liability, losses, costs and expenses (including attorneys' fees) incurred as a result of any Video you submit or transmit through the Site in violation of these terms.
Please also be aware that your Video will not be acknowledged and will not be received or held "in confidence" and your Video does not create a confidential, fiduciary or other special relationship between you and Sponsor, or any of its affiliates or any of its licensees, successors or assigns or place Sponsor or any of its affiliates, licensees, successors or assigns in a position that is any different from the position held by members of the general public with regard to elements of your Video. By uploading your Video, you acknowledge and agree that Sponsor or any of its affiliates or any of its licensees, successors or assigns may create their own materials and/or obtain many submissions under this Site and that such submissions may be similar or identical in theme, idea, plot, format or other respects to your Video and you waive any and all claims you may have had, may have, and/or may have in the future that any other Videos accepted, reviewed and/or used by the site or Sponsor or any of its affiliates or any of its licensees, successors or assigns may be similar to your Video. You acknowledge and agree that neither Sponsor nor any of its licensees, successors or assigns has now, or shall have in the future, any duty or liability, direct or indirect, vicarious, contributory or otherwise, with respect to the infringement or protection of any copyright in and to your Video, and that Sponsor and its licensees, successors or assigns are not responsible for the loss, deletion, failure to store or misdelivery of any Video submitted to or transmitted through the site.
